Purpose and Reason:

The proposed amendments to the Medical Assistance Program rules reflect statutory increases in the basic allowances for a community spouse and other dependents of an institutionalized individual. These basic allowances are used in the post-eligibility treatment of income process to calculate the allocation of income from an institutionalized individual to community dependents. The following standards were implemented under emergency rule making July 1, 2011 to ensure the standards were in compliance with state and federal guidance. This proposed rule is being filed under regular rule making provisions to sustain revisions in the DHS SNAP rules. • Minimum monthly maintenance needs allowance (MMMNA) for a community spouse with no income is increased to $1,838.75. • The basic allowance for a dependent living with a community spouse when the dependent has no income is increased to $612.92. • The excess shelter allowance is increased to $551.63.
